Elderly Man Files Claim Against a Police

I think it is unfortunate that these cases against law enforcement are becoming all too prevalent, especially since most police officers do admirable and courageous work.  In this brutality imagearticle http://www.courthousenews.com/2016/04/04/78-year-old-has-claim-against-small-town-cop.htm by Courthouse News, the writer tells of a 78 year old man who has filed a lawsuit against the city of Anderson, CA, its Police Chief, and one of the officers claiming battery, false imprisonment and false arrest.  Although the defense attorneys for the city were able to get the claim against the city dismissed, the city is still going to be on the hook for the actions of Officer Sean Miller. I currently have several of these cases that I’m litigating in Federal Court.  If the jury believes the Plaintiff’s version, he will clearly prevail on the claim alleging a violation of his Fourth Amendment right to be free from excessive force. The claim against the individual officer will only be dismissed if the Judge were to find as a matter of law that the force used by the officer was reasonable, but I don’t see how that could possibly happen in this case.  This is an interesting case to follow.  My guess is that the Plaintiff gets a sizable verdict or settlement.
